Biography

Ms. Vitek has over 15 years experience as an
attorney and more than 30 years experience in the
legal field. Her areas of practice have included insurance
law, employment law, product liability, consumer protection,
unfair business practices, complex litigation, class actions
as well as legal and medical malpractice for both plaintiff and
defense. She is experienced in appellate actions and has
prepared numerous writ petitions and appellate briefs as
well as participated in oral argument before the Court of Appeal.
Prior to joining RPNA, she was an associate at
Wasserman, Comden, Casselman & Pearson, LLP where she most
recently handled
complex litigation with an emphasis in class actions.
At RPNA, Ms. Vitek is representing both large and small
businesses in a variety of matters, including workers'
compensation insurance bad faith, insurance broker litigation
and commercial disputes. In addition, she represents the
interests of Indian tribes in various business, commercial and
insurance related matters. Her cases include complex
litigation matters as well as numerous class actions. |
Representative Experience

Obtained a class action settlement in excess of
$1 million on behalf of a class of 126 members arising out of
the purchase of "reacquired" vehicles for which the dealer and
manufacturer did not disclose the repair history or
circumstances of the vehicles' reacquisition from their
original purchasers. Each class member received in excess of
$7,700.

Successfully represented garment manufacturer
in an action against its commercial factor based upon
mishandling of the factoring accounts.

In numerous class actions, has successfully
defeated choice of venue and/or arbitration provisions.

Obtained summary adjudication of employer's
failure to provide rest breaks to certified class of over
13,000 members.
