Conference Focuses on California
Section 17200: One Of The Most Sweeping Consumer Protection Laws in
the Nation
PASADENA, CA, October 29, 2004—Drew Pomerance,
co-managing partner of Roxborough, Pomerance & Nye LLP, will be
speaking at the Mealey's California Section 17200 Conference on
November 8, 2004, at the Ritz-Carlton Hotel & Spa in Pasadena,
California.
The conference will address key issues associated with California’s
Unfair Competition Law, Section 17200, which was designed to protect
consumers from unfair business practices. Section 17200 allows
plaintiffs to file for broad equitable relief and restitution
ordinarily not available in an individual damage action and does not
require that the plaintiff show injury from the unlawful business
practice. Due to its broad scope, the law not only covers consumer
suits but competitor vs. competitor suits raising issues of trade
secrets, customer lists, and the protection of intellectual property
rights.
“This is one of the most unsettled areas of litigation for
businesses of all kinds,” says Pomerance. “Given its controversial
and expansive scope, Section 17200 has created a climate in which it
has been utilized in numerous other areas of legal practice and
consumer protection including employment, health care, and
insurance.”
An expert on all aspects of insurance coverage and bad faith
disputes, Pomerance will be providing an analysis of 17200 actions
filed against insurance companies, claims asserted, defenses and an
update of the most recent cases involving insurance. He joins other
plaintiff and defense attorneys, in-house counsel, government
attorneys, legislators, judges, and other experts who will discuss
the advantages and disadvantages of using 17200 in litigation, the
best strategies for plaintiffs and defendants to use in 17200 cases,
limitations on the use of Section 17200, and tips on settlement and
arbitration.
