DREW POMERANCE OPENS TWO-DAY
CONFERENCE ON BAD FAITH LITIGATION
LOS ANGELES, CA, March 12, 2007—Emerging trends in California’s
bad faith law—one of the most sophisticated and developed in the
nation—was discussed at the Mealey’s California Bad
Faith Conference held today at the Ritz-Carlton Hotel in
Marina del Rey, California.
Drew Pomerance of Roxborough, Pomerance & Nye LLP and James Robie of
Robie & Matthai opened the two-day conference with a
session about innovative and emerging theories on bad faith.
Pomerance, one of the most experienced class action attorneys in the
country who has dedicated his practice to representing businesses in
coverage and bad faith disputes against insurers, discussed his
theories on what constitutes bad faith and the emergence of new
exposures for insurance carriers involved in workers’ compensation
cases.
"We have seen so many ways in which insurance companies overcharge
their insureds or otherwise don't perform their obligations in good
faith, that new theories and litigation trends have developed to
hold carriers accountable," says Pomerance.
Pomerance and Robie were joined by a host of experts including
plaintiff and defense attorneys, in-house counsel, government
attorneys, legislators, and judges who presented other
topics such as:
- Emerging bad faith defenses
- Special issues associated with handling bad
faith cases involving life and disability claims
- A discussion of important California bad
faith and punitive damages decisions
- Arizona bad faith issues and what California
attorneys can learn from them
- An update on Prop 64, its retroactivity, and
changes concerning Business and Professional Code §17200 claims.
